Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the 1ClickTrust platform ("Service"), operated by 1ClickTrust ("we", "us", or "our").

By creating an account, activating a QR code, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

1ClickTrust is a business-to-business software platform for local merchants. The Service helps you collect direct feedback from customers, offer optional loyalty programs, and give satisfied customers a simple path to your Google review page.

Features may include QR-based review pages, a private feedback inbox, store management, analytics, optional loyalty stamp cards, staff kiosk mode, embeddable widgets, and subscription billing. Available features depend on your plan.

3. Eligibility

• You must be at least 18 years old and authorized to act on behalf of a business.
• You must provide accurate registration information and keep your account credentials secure.
• You may not use the Service for unlawful purposes or in violation of these Terms.

4. Account and trial

Accounts are created with email and password. New self-signup accounts may receive a 14-day Starter trial with full Starter features. After the trial, accounts may downgrade to the Free plan unless you upgrade.

Your billing market (Vietnam or global) is set at signup based on detected location and your confirmation. It is locked after signup. Contact 1clicktrust.admin@gmail.com if you believe your market was set incorrectly.

5. Plans, billing, and limits

We offer Free, Starter, and Pro subscription tiers with different store limits, analytics, and feature access. Current limits and prices are shown on our pricing page.

Global customers may pay via Stripe. Vietnam customers may upgrade via bank transfer or contact as described on the billing page. Physical QR products may include bundled trial periods.

If you downgrade from Pro, excess stores may be frozen. QR codes continue to work, but some dashboard actions and inbox delivery may be limited until you upgrade or select a primary store.

Fees are non-refundable except where required by law or explicitly stated otherwise.

6. Merchant responsibilities

When you use loyalty or feedback features, you are the data controller for your customers' personal information collected through your store. 1ClickTrust processes that data on your behalf as a service provider.

You are responsible for obtaining any consent required from your customers under applicable privacy laws, including Vietnam's Personal Data Protection Decree (NĐ 13/2023) and, where applicable, the Australian Privacy Act.

Merchants are solely responsible for ensuring their use of the Service complies with applicable third-party policies, including Google's review contribution policies.

You must not spam customers, abuse feedback forms, attempt to bypass rate limits, or use the Service to collect unlawful content.

7. Acceptable use

• Do not reverse engineer, scrape, or interfere with the Service.
• Do not upload malware, illegal content, or content that infringes others' rights.
• Do not share kiosk or staff links with unauthorized persons. You are responsible for access to staff kiosk sessions.
• Do not misrepresent your business or impersonate another party.

8. Intellectual property and branding

We own the Service, software, and 1ClickTrust branding. Pro plan white-label features allow you to display your own logo and brand colors on public review and loyalty pages. You retain ownership of your uploaded brand assets.

You grant us a limited license to host, display, and process your store data as needed to operate the Service.

9. Third-party services

The Service integrates with third parties such as Google Places and Maps, Stripe, Supabase, Brevo, Cloudflare Turnstile, and Vercel. Your use of those services may be subject to their own terms.

We do not control third-party platforms and are not responsible for their availability, policies, or actions.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

We do not guarantee specific Google ratings, review counts, search rankings, or business outcomes. Results depend on your service quality and customer experience.

11. Limitation of liability

To the maximum extent permitted by law, 1ClickTrust and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim, or USD $100 if you are on a free plan.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms, pose security risks, or remain unpaid where payment is required.

Upon termination, your right to access the Service ends. We may retain data as described in our Privacy Policy and as required by law.

13. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, notify you by email or in the dashboard.

Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Disputes should first be raised with us at 1clicktrust.admin@gmail.com.
